SHU UEMURA ART OF HAIR GALLERY OF STYLE STYLIST CONTEST

NO PURCHASE IS NECESSARY TO ENTER OR WIN.

The Shu Uemura Art of Hair Gallery of Style Stylist Contest (the “Contest”) starts on March 3, 2017 at 12:00 AM Eastern Time (“ET”) and ends on June 16, 2017 at 11:59 PM (“ET”) (“Contest Period”). There are five (5) phases of the Contest. Sponsor’s computer shall be the official timekeeper for all matters related to this Contest.

ELIGIBILITY: Contest is open to legal residents of the fifty (50) United States (excluding Puerto Rico) and the District of Columbia, 18 years of age or older at time of entry. Entrants must be stylists employed by a Shu Uemura Art of Hair Salon. Anyone under the age of majority in their state, (eighteen (18) in most states, nineteen (19) in Alabama and Nebraska, and twenty-one (21) in Mississippi) at the time of entry must also have the consent of one of his or her parents or legal guardian, and a parent or other legal guardian must agree to the enforceability of these Official Rules. Employees of Shu Uemura Art of Hair (“Sponsor”), and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws.

HOW TO ENTER: During the Entry Phase, 1) visit www.shuuemuraartofhair-usa.com/gallery-of-style and follow the links to the 2017 Gallery of Style Challenge site to review information on the theme, “TokyoRama”; 2) follow the instructions to complete the application form by providing your name, valid email address, phone number and salon name; 3) submit four (4) photos (“Entry”) as follows:  before styling; hairstyle front view; hairstyle profile three-quarter (3/4) view; hairstyle back view; 4) in three (3) to four (4) sentences, no more than 100 words in total, describe the inspiration behind the look including what Shu Uemura Art of Hair products were used. Stylists may only use Shu Uemura Art of Hair products and should use complimentary Shu Art of Hair products provided to salons.  One (1) Entry per stylist, per email address for the duration of the Entry Phase.  Entries received from any person or email address in excess of the limitation will be void. Entries generated by script, macro or other automated means or by any means which subvert the entry process are void. 

Entrant is responsible for obtaining, prior to submission of the Entry, any and all necessary releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. Other than the Entrant, all other individuals must be at least 18 years of age. If requested, Entrant must be able to provide such permissions or proof in a form acceptable to Sponsor.  Failure to provide such proof may, if requested, render Submission null and void.

Entrant agrees that during the Contest Period, they will not post any of their Submissions on Facebook or any other social network without the consent of Sponsor.

In the event of a dispute as to any Entry, the authorized account holder of the email address used to register will be deemed to be the entrant and must comply with these Official Rules.  The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each entrant may be required to show proof of being an authorized account holder.

REQUIREMENTS OF ENTRIES

Entry may not contain, as determined by the Sponsor, in its sole discretion, any content that:

  • contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
  • contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
  • contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission;
  • is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);
  • promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
  • is obscene or offensive; endorses any form of hate or hate group;
  • appears to duplicate any other submitted Entries;
  • defames, misrepresents or contains disparaging remarks about other people or companies;
  • communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate;
  • and/or violates any law.

Entry must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity.  If the Entry contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Entry null and void.

By submitting an Entry, entrant acknowledges and agrees that Sponsor may obtain many Entries in connection with this Contest and/or other contests staged and/or promoted by the Sponsor, and that such Entries may be similar or identical in theme, idea, format or other respects to other Entries submitted in connection with this Contest and/or other contests sponsored by the Sponsor or submitted for other reasons or other materials developed by the Sponsor. Entrant waives any and all claims entrant may have had, may have, and/or may have in the future, that any Entry and/or other works accepted, reviewed and/or used by the entrant may be similar to his/her Entry, or that any compensation is due to entrant in connection with such Entry or other works used by Sponsor.

By submitting an Entry, entrant hereby grants permission for the Entry to be posted on Shu Uemura Art of Hair, and its affiliates, branded websites or social platforms. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry. Entrants agree that they will not use the Entry for any other purpose, including, without limitation, posting the Entry to any online social networks, without the express consent of Sponsor in each instance.

WINNER DETERMINATION: Winners will be determined by the following process:  First, the Sponsor will select the top fifteen (15) Entries (Semi-Finalists) based on objective judging criteria listed below.  Then, the public will vote on the Semi-Finalists’ Entries to determine the five (5) Finalists.  Finally, the Sponsor will select the potential National Competition Winner based on the judging criteria listed below.  The full process is described below.

a. Initial Judging Phase: During the Initial Judging Phase, a panel of qualified judges determined by Sponsor in its sole discretion will score all eligible Entries based on the following Judging Criteria:

  • Successful interpretation of the 2017 “TokyoRama” theme (35%);
  • Artistic creativity and originality of final look (25%) and;
  • Successful representation of Shu Uemura Art of Hair brand (20%) and;
  • Level of technical execution, finishing balance in shape and silhouette (20%)

The fifteen (15) entrants with the highest-scoring Entries will be deemed Semi-Finalists. In the event of a tie, the entry which received the highest score for “successful interpretation of the 2016 “TokyoRama” theme,” as determined by the qualified judges, in their sole discretion, will be deemed the applicable Semi-Finalist.  Sponsor reserves the right to select fewer than fifteen (15) Semi-Finalists, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.

b. Public Voting: During the Public Voting Phase, the Semi-Finalists' Entries will be posted in an online gallery for public voting at www.shuuemuraartofhair-usa.com/gallery-of-style.  Legal residents of the United States will be permitted to vote for the Entry they believe is best. Limit:  each person may vote one (1) time per day during the Voting Phase.  For the purposes of this contest, a day is defined as beginning at 12:01 AM ET and ending the following 11:59 PM ET.  The five (5) Semi-Finalists whose Entries receive the most votes will be deemed the Finalists. In the event of a tie, the Semi-Finalist who received his/her final vote first will be the applicable Finalist.

Multiple votes received from any person or email address in excess of the stated number will be void. Any attempt by any Semi-Finalist or voter to obtain more than the stated number of votes by any fraudulent or inappropriate means, including without limitation, offering prizes or other inducements to members of the public as determined by Sponsor in its sole discretion, by using any automated program, by using multiple/different email addresses, identities, registrations and logins, or any other methods, will void those votes for the entrant's Entry and entrant may be disqualified as determined by Sponsor in its sole discretion.  Sponsor reserves the right, in its sole discretion, to revise the vote counts should the voting as a whole appear to have been tampered with or manipulated in significant way.

c. Final Judging Phase: During the Final Judging Phase, a panel of qualified judges determined by Sponsor in its sole discretion will review and score the entries of the five (5) Finalists using the Judging Criteria described above. The three (3) Finalists with the highest-scoring entries will be deemed the potential National Competition Winners. In the event of a tie, the entrant whose Entry received the highest score for “successful interpretation of the 2017 “TokyoRama” theme,” as determined by the qualified judges, in their sole discretion, will be deemed the applicable potential winner.  Sponsor reserves the right to not select three (3) winners, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.

SEMI-FINALIST/FINALIST NOTIFICATION:  Potential Semi-Finalists will be notified by email or phone on or about April 6, 2017, and potential Finalists will be notified on or about April 27, 2017, using the contact information provided on the application form.  Potential Finalists will be required to sign and return an Affidavit of Eligibility and Release and where not prohibited a Publicity Release, which must be received by Sponsor within five (5) days of the date notice or attempted notice is sent, in order to claim prize.  If a potential Finalist cannot be contacted, fails to execute and return the Affidavit of Eligibility and Release and Publicity Release or provide any other requested information within the required time period (as applicable), does not comply with these Official Rules, or notification is returned as undeliverable, potential Finalist forfeits the prize. If a potential Finalist is disqualified for any reason, the applicable prize may be awarded to a runner-up, if any, in Sponsor’s sole discretion. Acceptance of any prize shall constitute and signify each Finalist’s agreement and consent that Sponsor and its designees may use the Finalists’ name, city, state or province, territory, likeness, Entry and/or prize information in connection with the Program for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.

NATIONAL FINALS:  The five (5) Finalists will participate in a national competition to take place May 21 – 22, 2017 in New York City, New York. The Finalists will be required to recreate their submitted look.  The finalized look will be professionally photographed showing the look before styling, from the front, profile and back. The Judges will use the same criteria as stated above in determining the three (3) potential National Competition winners.  The three (3) winning looks will be submitted into the Shu Uemura Gallery of Style Global competition for a chance to win a trip to Tokyo, Japan. 

PRIZES:  Finalists will be provided a paid two (2) night and two (2) day stay in New York City, New York including: coach, standard or economy-class round-trip airfare or other transportation (as selected by Sponsor) from a major airport near the Finalists’ home (airport and airline or other transportation selected by Sponsor in its sole discretion), one (1) standard room double occupancy hotel room at a hotel selected by Sponsor; ground transportation to and from the hotel and New York area airport and transportation to the event location(s), provided by Sponsor. All other expenses not specified above including, but not limited to, all other meals, beverages, gratuities, incidentals, taxes, other ground transportation, and baggage handling fees for bags in excess of one bag per are the sole responsibility of each Finalist. Approximate Retail Value (“ARV”): $800. Total ARV of all prizes: $4,000. Final actual value at time of booking and travel may be substantially more or less depending on point of origin and ticket availability. Winner shall reasonably cooperate with Sponsor to arrange for the prompt booking of their travel arrangements. All airline or other travel tickets once booked cannot be changed unless Sponsor in its sole discretion consents. Any additional fees or penalties incurred as a consequence of any changes made to any travel arrangements after they are booked that are made at the request of a Finalist are the sole responsibility of such Finalist; Sponsor does not provide travel or other insurance.  Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize (or a component thereof) for one of equal or greater value if the designated prize should become unavailable for any reason.  Finalists are responsible for all taxes and fees associated with prize receipt and/or use. 

GENERAL CONDITIONS:  By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge and hold harmless Sponsor, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize including any travel/activity related thereto, including any harm/injury caused from the use of a vehicle.

PUBLICITY: By participating, each entrant agrees to the use of his/her name, voice, Submission, Prize Footage, performance, photograph/video, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, without limitation and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from  entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.  By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Contest without the prior consent of the Sponsor, which it may withhold in its sole discretion. 

OWNERSHIP/USE OF ENTRIES:  By submitting an Entry, each entrant agrees Sponsor, and its affiliates, shall own the Entry submitted (including the copyright thereto and all rights embodied therein) and that it and its designees may exploit, edit, modify, and distribute the Entry and all elements of such Entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to entrant or any third party.  

MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries,  the tabulation of votes, the announcement of the prize, the incorrect uploading of the photo or in any Contest-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest.  Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website.  Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or Entry of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect Entries received prior to action taken using the judging procedure outlined above. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Promotion, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.

USE OF DATA: Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy at www.shuuemuraartofhair-usa.com. By participating in the Contest, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
